CRASH ACTING
ONLINE COURSE & MEMBERSHIP TERMS & CONDITIONS
These Online Course & Membership Terms & Conditions (“Terms”) govern the purchase of, access to, and use of online courses, digital educational materials, online memberships, and related online resources offered by Crash Acting and/or Crash Creative Studios (“Crash Acting,” “we,” “us,” or “our”).
For purposes of these Terms:
“Course” means an individual online course, program, or collection of digital educational materials purchased for a one-time fee or, where expressly offered, through an installment payment plan.
“Membership” means an ongoing subscription-based online offering for which the Participant is charged a recurring membership fee, generally on a monthly basis.
“Services” collectively refers to Courses, Memberships, digital materials, Community Spaces, and other online resources provided by Crash Acting.
By checking the box indicating acceptance of these Terms and completing a purchase or enrollment, you (“Participant,” “you,” or “your”) acknowledge that you have read, understand, and agree to be legally bound by these Terms.
I. ONLINE FORMAT
1. Self-Guided Educational Content
Crash Acting's Courses and Memberships are online educational offerings consisting primarily of pre-recorded and/or written educational materials, exercises, resources, and other digital content.
Unless expressly stated otherwise on the applicable sales, checkout, Course, or Membership page, the Services:
- Do not include live classes;
- Do not include live instruction;
- Do not include individual coaching;
- Do not include individualized feedback or evaluation;
- Do not include office hours, live Q&A sessions, or other scheduled interaction with instructors;
- Do not include a live community experience; and
- Do not require Crash Acting instructors, employees, contractors, or staff members to personally interact or communicate with Participants.
Course materials may generally be completed at the Participant's own pace, subject to any access period expressly stated for the applicable Course.
Membership content may be added, removed, replaced, or updated periodically during the Participant's active Membership.
2. Community and Course Platform
Certain Courses or Memberships may be hosted within or provide access through an online community, membership portal, discussion space, or similar digital platform (“Community Space”).
Unless expressly stated otherwise in writing, any Community Space associated with the Services exists primarily as a vehicle through which Participants may access Courses, Membership materials, resources, announcements, and related content.
Access to a Community Space does not mean that a Course or Membership includes a live community experience, group coaching, instructor access, individualized feedback, or direct support from Crash Acting instructors or staff.
Participants may have the ability to post comments, questions, messages, or other content within a Community Space. Crash Acting instructors, employees, contractors, and staff members are not required to monitor, read, acknowledge, or respond to any message, post, comment, question, or other communication submitted through the Community Space.
The availability of communication features within the platform does not create an obligation for Crash Acting or any individual instructor or staff member to communicate directly with Participants.
3. No Individualized Instruction
Course and Membership materials are provided for general educational purposes and are not individualized to any particular Participant.
Purchasing a Course or Membership does not create an individual coaching, mentoring, advisory, or instructional relationship between the Participant and Benjamin Mathes, any other Crash Acting instructor, or any Crash Acting employee, contractor, or representative.
Any individual coaching or other service purchased separately will be governed by the terms applicable to that service.
II. ELIGIBILITY AND ACCOUNT ACCESS
1. Adult Participants
Crash Acting's online Services are intended for adults age eighteen (18) or older unless a particular offering expressly states otherwise.
By purchasing or accessing the Services, you represent that you are at least eighteen (18) years old and have the legal capacity to enter into these Terms.
2. Account Information
Participants may be required to create an account or profile to access Course or Membership materials.
You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring through your account.
You agree to provide accurate and current information when creating or maintaining your account.
3. Individual Use Only
Access is licensed solely to the individual who purchased or was authorized to access the applicable Course or Membership.
Participants may not:
- Share usernames, passwords, or login credentials;
- Permit another individual to access Course or Membership materials through their account;
- Purchase a single Course or Membership for use by multiple individuals unless Crash Acting has expressly authorized such use;
- Copy or distribute materials to another person; or
- Circumvent technological restrictions designed to control access.
Crash Acting may suspend or terminate access if it reasonably believes an account is being shared or otherwise used in violation of these Terms.
III. PURCHASES, PAYMENTS, AND SUBSCRIPTIONS
1. Course Purchases
The purchase price for an individual Course will be disclosed before checkout.
Courses may be offered either:
For a single one-time payment; or
Through an installment payment plan, if expressly offered at checkout.
Payment is due according to the option selected by the Participant at checkout.
Once payment has been completed or an authorized payment plan has begun, the Participant will receive access to the applicable Course according to the access terms presented at the time of purchase.
2. Course Payment Plans
If Crash Acting allows the purchase price of a Course to be paid through installments, the installment arrangement is a method of paying the total Course purchase price over time.
An installment payment plan for a Course is not a Membership or subscription and cannot be canceled simply by discontinuing use of the Course.
Once Course access has been provided, the Participant remains responsible for all remaining installment payments unless otherwise required by applicable law or expressly provided under an applicable refund policy.
Completion of the Course, failure to use the Course, loss of interest, or a Participant's decision to stop participating does not eliminate the remaining payment obligation.
3. Membership Subscriptions
Memberships are ongoing subscription services.
By purchasing a Membership, the Participant authorizes Crash Acting and its payment processor to automatically charge the applicable recurring Membership fee to the payment method provided at checkout.
Unless otherwise expressly stated at checkout, Memberships are billed monthly and automatically renew each month until canceled.
The price and billing frequency applicable to the Membership will be disclosed before purchase.
By enrolling in a Membership, the Participant acknowledges and agrees that:
- The Membership is an automatically renewing subscription;
- The Participant will be charged the disclosed Membership fee each billing cycle;
- Recurring charges will continue until the Membership is canceled;
- The Participant is responsible for canceling the Membership if they no longer wish to continue it; and
- Merely stopping use of the Membership, Community Space, or Membership materials does not cancel the Membership.
4. Membership Cancellation
A Participant may cancel their Membership at any time using the cancellation method made available by Crash Acting or by contacting Crash Acting through the designated administrative contact method.
Unless otherwise required by applicable law or expressly stated for a particular Membership, cancellation takes effect at the end of the Participant's then-current paid billing period.
The Participant will retain access to the Membership through the end of that paid billing period and will not be charged for the next billing cycle.
Canceling a Membership does not generally result in a refund or prorated refund for amounts already charged.
After cancellation becomes effective, access to Membership-only Courses, materials, resources, Community Spaces, and other subscription benefits may be terminated.
Canceling a Membership does not cancel or eliminate any separate payment obligation associated with an individually purchased Course or Course installment plan.
5. Failed Payments
Participants are responsible for maintaining a valid and current payment method.
If a scheduled Course installment or Membership payment fails, Crash Acting or its payment processor may attempt to process the payment again.
Crash Acting may suspend access to the applicable Course or Membership while an amount remains unpaid.
For Memberships, continued failure to process payment may result in cancellation or termination of the Membership.
For Course installment plans, suspension or termination of access due to nonpayment does not necessarily eliminate the Participant's obligation to pay the remaining balance of the Course purchase price.
6. Changes to Membership Pricing
Crash Acting may change Membership pricing from time to time.
Any change to the recurring price charged to an existing Participant will be implemented in accordance with applicable law and any notice requirements that apply.
A Participant who does not wish to continue a Membership following a permitted price change may cancel the Membership before the new price becomes applicable.
IV. REFUNDS
1. Course Purchases
Except where otherwise expressly stated on the applicable Course sales or checkout page or required by applicable law, Course purchases are final and non-refundable once access to the Course has been provided.
Because Courses consist of digital educational content that may be made available immediately after purchase, Crash Acting does not provide refunds solely because of:
- Failure to access or complete the Course;
- A Participant's schedule or availability;
- A change of mind;
- A Participant deciding that the Course is not personally useful or relevant;
- Failure to achieve a particular artistic, professional, financial, career, or personal result; or
- A Participant's decision to discontinue participation.
2. Membership Payments
Membership fees are charged in exchange for access during the applicable billing period.
Except where required by law or expressly stated otherwise, Membership fees that have already been charged are non-refundable and will not be prorated based on the Participant's level of use or the date on which the Participant chooses to cancel.
Cancellation prevents future renewal charges but does not ordinarily reverse a charge for a billing period that has already begun.
3. Course-Specific or Membership-Specific Policies
If Crash Acting expressly offers a different refund or cancellation policy for a particular Course or Membership at the time of purchase, the specific policy presented for that offering will control in the event of a conflict with this Section.
Nothing in these Terms limits any refund, cancellation, or consumer protection right that cannot legally be waived.
V. ACCESS TO COURSES AND MEMBERSHIP MATERIALS
1. Individually Purchased Courses
The applicable Course description or purchase page may specify the period during which an individually purchased Course will remain accessible.
If a specific access period is stated, access will expire at the conclusion of that period.
If Course access is described as “lifetime access,” “permanent access,” or similar language, such access means access for as long as Crash Acting continues to offer and host the applicable Course, subject to these Terms. It does not guarantee that a particular platform, website, technology provider, or hosting service will exist indefinitely.
2. Membership Content
Access to Membership materials is conditioned upon maintaining an active, paid Membership.
During an active Membership, Participants will have access to the materials and benefits then included within the applicable Membership level.
Membership content may evolve over time. Crash Acting may:
Add new Courses or materials;
- Remove or retire existing Courses or materials;
- Replace or update content;
- Reorganize the Membership library;
- Change the platform through which Membership materials are delivered; or
- Modify the specific content included in the Membership.
Purchasing a Membership does not guarantee permanent access to any specific Course, lesson, resource, instructor, feature, or item that happens to be included in the Membership at a particular time.
Unless a Participant separately purchases a Course outside of the Membership, access to Courses or other materials included solely as part of a
Membership ends when the Membership ends.
3. Platform Availability
Crash Acting makes reasonable efforts to maintain access to its Services but does not guarantee uninterrupted or error-free availability.
Access may occasionally be unavailable because of:
- Platform maintenance;
- Software or hosting interruptions;
- Internet outages;
- Security issues;
- Third-party service disruptions;
- Updates or modifications; or
- Circumstances outside Crash Acting's reasonable control.
Temporary interruptions do not generally entitle Participants to a refund.
4. Updates and Modifications
Crash Acting may periodically update, revise, reorganize, replace, remove, or supplement materials in order to improve its educational offerings, maintain its programs, or reflect changes in Crash Acting's methods and practices.
Crash Acting may also migrate Courses or Memberships to a different hosting platform or delivery system.
Reasonable modifications to content or delivery do not constitute cancellation of a Course or Membership.
VI. INTELLECTUAL PROPERTY
1. Ownership
All Course and Membership materials are owned by or licensed to Crash Acting and are protected by applicable copyright, trademark, and other intellectual-property laws.
Materials may include, without limitation:
- Videos;
- Audio recordings;
- Lessons;
- Lectures;
- Written materials;
- Workbooks;
- Exercises;
- Worksheets;
- Scripts;
- Graphics;
- Course frameworks;
- Teaching methodologies;
- Downloads;
- Presentation materials;
- Templates; and
- Other proprietary educational content.
Purchasing a Course or Membership does not transfer ownership of any materials or intellectual property to the Participant.
2. Limited License
Crash Acting grants each Participant a limited, personal, non-exclusive, non-transferable, revocable license to access and use the materials made available to them solely for their own personal educational purposes.
For Membership materials, this license generally continues only while the Participant maintains an active Membership, unless Crash Acting expressly states otherwise.
3. Prohibited Uses
Without prior written permission from Crash Acting, Participants may not:
- Copy, reproduce, republish, upload, post, transmit, or distribute Course or Membership materials;
- Record, screen-record, download, or capture content except where Crash Acting expressly provides a download function;
- Share materials with individuals who have not purchased or otherwise been granted authorized access;
- Sell, sublicense, license, rent, or commercially exploit the materials;
- Modify the materials and distribute the modified materials;
- Use Crash Acting materials to create a competing course, membership, program, workshop, curriculum, or commercial product;
- Remove copyright, trademark, or proprietary notices;
- Publicly display Course or Membership videos or materials; or
- Otherwise use Crash Acting's intellectual property outside the limited personal-use license granted by these Terms.
Unauthorized reproduction or distribution may result in immediate termination of access and may subject the Participant to legal action.
VII. PARTICIPANT CONTENT AND ONLINE CONDUCT
1. Participant Content
If the applicable platform permits Participants to submit comments, posts, questions, photographs, videos, recordings, written work, or other materials (“Participant Content”), the Participant retains ownership of their original content.
By voluntarily posting Participant Content within a Course, Membership, or Community Space, the Participant grants Crash Acting a limited license to host, store, display, and technically reproduce that content as reasonably necessary to operate its Services.
Crash Acting will not use a Participant's name, image, likeness, performance, testimonial, or submitted creative work for external advertising or promotional purposes without any additional permission required by applicable law.
2. Online Conduct
Where Participants are able to interact with one another, all Participants are expected to communicate respectfully and professionally.
Participants may not use Crash Acting's platforms to engage in:
- Harassment;
- Discrimination;
- Threats or intimidation;
- Bullying;
- Retaliation;
- Sexual harassment;
- Repeated unwanted contact;
- Abusive or coercive behavior;
- Deliberate disruption;
- Unauthorized solicitation or advertising;
- Impersonation;
- Sharing another person's private information without authorization; or
- Conduct that materially interferes with another Participant's ability to safely use the platform.
Crash Acting may remove content or suspend or terminate access for violations of these standards.
VIII. EDUCATIONAL PURPOSE AND PARTICIPANT RESPONSIBILITY
1. Educational Purpose
Crash Acting provides artistic and educational instruction intended to assist Participants in exploring acting, creativity, artistic process, and related subjects.
Crash Acting's Courses and Memberships are educational resources. They are not therapy, mental-health treatment, medical care, or psychological counseling.
Participation does not create a therapist-patient, doctor-patient, attorney-client, fiduciary, or other professional relationship.
2. Personal Responsibility
Acting and artistic exploration may involve emotionally challenging subject matter.
Participants are responsible for determining whether particular exercises, materials, performances, or subject matter are appropriate for them.
Participants may choose not to complete an exercise or activity they believe would violate their personal, emotional, psychological, or physical boundaries.
Participants are responsible for seeking appropriate professional support when needed.
IX. NO GUARANTEE OF RESULTS
Crash Acting does not guarantee any particular result from purchasing or participating in a Course or Membership.
Individual results vary based on numerous factors outside Crash Acting's control, including a Participant's experience, effort, practice, abilities, circumstances, opportunities, and decisions.
Crash Acting makes no guarantee that participation will result in:
- Representation by an agent or manager;
- Auditions;
- Casting opportunities;
- Employment;
- Increased income;
- Career advancement;
- Admission into any program;
- Improvement of any particular skill to a specified level; or
- Any particular artistic, professional, financial, or personal outcome.
Testimonials, examples, or experiences shared by instructors or Participants are illustrative only and do not guarantee that another Participant will achieve the same or similar results.
X. PROFESSIONAL BOUNDARIES AND SEXUAL MISCONDUCT
1. Scope
Crash Acting is an adult artistic and educational environment. Crash Acting's online Services do not issue grades, degrees, professional certifications, employment opportunities, or guarantees of casting or representation.
Crash Acting nevertheless recognizes that educational and mentorship relationships can involve trust, influence, and emotional openness.
These standards apply to interactions occurring through Crash Acting's Courses, Memberships, Community Spaces, communications, and other
related online environments.
2. Consent
Consent must be affirmative, voluntary, informed, and revocable at any time.
Consent cannot be assumed from silence, prior interactions, participation in Crash Acting programs, participation in artistic exercises, or previous personal relationships.
3. Sexual Misconduct
Sexual misconduct includes non-consensual, coercive, harassing, or repeatedly boundary-violating sexual behavior.
Sexual misconduct may include:
- Unwanted sexual advances or propositions;
- Sexual harassment through written, verbal, visual, or electronic communications;
- Sexual coercion;
- Repeated sexualized communications after a boundary has been expressed;
- Retaliation following rejection or reporting; or
- Other sexual conduct that materially interferes with another person's ability to participate safely.
Sexual misconduct is prohibited within Crash Acting's Course- and Membership-related environments.
4. Instructor and Participant Boundaries
Crash Acting instructors and staff are expected to maintain appropriate professional boundaries with Participants.
Participants are likewise expected to respect the boundaries of instructors, staff, and other Participants.
Purchasing or maintaining access to a Course or Membership does not create an entitlement to personal access, communication, friendship, mentorship, professional referrals, casting consideration, employment consideration, or a personal relationship with any Crash Acting instructor or staff member.
XI. REPORTING CONCERNS
Crash Acting seeks to maintain an educational environment that supports artistic growth, personal dignity, safety, accountability, and professional integrity.
Participants may report concerns involving:
- Harassment;
- Discrimination;
- Sexual misconduct;
- Boundary violations;
- Abuse of power;
- Retaliation;
- Unsafe behavior; or
- Serious violations of these Terms.

Where available, Participants may also contact Crash Acting's designated independent third-party mediation or support organization.
Crash Acting may assess reports and determine an appropriate response based upon the circumstances.
Possible responses may include:
- Requesting additional information;
- Removing content;
- Restricting communication between Participants;
- Issuing warnings;
- Suspending access;
- Terminating Course, Membership, or Community Space access;
- Consulting an independent third-party professional; or
- Taking other reasonable action appropriate to the circumstances.
Crash Acting prohibits retaliation against anyone who makes a good-faith report or participates in a review of a reported concern.
XII. RESTORATIVE JUSTICE AND COMMUNITY VALUES
Crash Acting's approach to community concerns is informed by principles of restorative justice, including:
- Safety before resolution;
- Accountability over punishment;
- Repair over blame;
- Process over reactivity; and
- Human dignity for all involved.
When appropriate and safe, Crash Acting may offer or facilitate a restorative process.
Such a process may include individual listening sessions, facilitated dialogue, impact statements, behavioral agreements, education, or other measures intended to promote accountability and repair.
Participation in restorative dialogue is voluntary. No Participant who reports experiencing harm will be required to engage directly with another individual as a condition of having their concern heard or addressed.
Restorative principles do not prevent Crash Acting from imposing consequences, including suspension or termination of access, when Crash Acting determines such action is appropriate.
XIII. DISCLAIMER AND LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Participants voluntarily assume the ordinary risks associated with acting exercises, artistic exploration, self-guided educational activities, and the use or application of online educational materials.
Crash Acting, Crash Creative Studios, Benjamin Mathes, affiliated instructors, employees, contractors, representatives, and related entities are not responsible for emotional, psychological, physical, professional, financial, or other loss resulting from a Participant's voluntary use or application of Course or Membership materials, except to the extent liability cannot lawfully be excluded or limited.
Crash Acting is not responsible for the acts, statements, conduct, advice, or communications of other Participants.
TO THE FULLEST EXTENT PERMITTED BY LAW, CRASH ACTING'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO A PARTICIPANT'S PURCHASE OR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY THAT PARTICIPANT TO CRASH ACTING FOR THE SPECIFIC COURSE OR, IN THE CASE OF A MEMBERSHIP CLAIM, THE MEMBERSHIP FEES PAID DURING THE PERIOD GIVING RISE TO THE CLAIM.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
XIV. THIRD-PARTY PLATFORMS AND SERVICES
Crash Acting may use third-party platforms and service providers to host materials, process payments, send communications, or provide other technology.
Participants' use of third-party platforms may also be subject to the applicable provider's terms and privacy practices.
Crash Acting is not responsible for interruptions, changes, failures, security incidents, or other acts or omissions of third-party providers outside Crash Acting's reasonable control.
XV. SUSPENSION OR TERMINATION OF ACCESS
Crash Acting may suspend, restrict, or terminate a Participant's Course, Membership, or Community Space access if the Participant materially violates these Terms, including by:
- Sharing account access;
- Infringing Crash Acting's intellectual property;
- Harassing instructors, staff, or other Participants;
- Engaging in prohibited conduct;
- Misusing the platform;
- Attempting to compromise platform security; or
- Failing to make payments lawfully owed.
Where appropriate, Crash Acting may provide notice and an opportunity to correct a violation before terminating access.
Crash Acting may take immediate action when reasonably necessary to protect its intellectual property, platform security, personnel, Participants, or community.
Termination resulting from a Participant's material violation of these Terms does not automatically entitle the Participant to a refund.
If Crash Acting terminates an ongoing Membership, no additional recurring Membership charges will be made after the effective date of termination, except for amounts already due or otherwise lawfully owed.
XVI. COMMUNICATIONS
By purchasing a Course or Membership, Participants consent to receive transactional and Service-related electronic communications reasonably necessary to provide the purchased Services, including:
- Purchase confirmations;
- Payment and billing notices;
- Account notices;
- Course or Membership updates;
- Access information; and
- Administrative communications.
Marketing communications will be governed by applicable law and the Participant's applicable communication preferences.
XVII. PRIVACY
Crash Acting may collect and process personal information as reasonably necessary to administer purchases and subscriptions, provide access, communicate with Participants, maintain its platforms, process payments, and operate its business.
Crash Acting's collection and use of personal information is also subject to any applicable Privacy Policy made available by Crash Acting.
Participants should not post sensitive personal information within Community Spaces or other areas visible to other Participants.
XVIII. CHANGES TO THESE TERMS
Crash Acting may update these Terms periodically to reflect changes to its Services, technology, policies, business practices, or legal obligations.
Material changes applicable to existing Participants will be communicated or made available through reasonable means.
Unless otherwise permitted by applicable law, changes will not retroactively alter payment obligations or other material contractual rights associated with a completed Course purchase or Membership billing period.
XIX. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
XX. NO WAIVER
Crash Acting's failure to enforce any provision of these Terms on one occasion does not constitute a waiver of its right to enforce that provision or any other provision in the future.
XXI. ENTIRE AGREEMENT
These Terms, together with the applicable Course or Membership description, checkout terms, refund and cancellation policies, Privacy Policy, and any other terms expressly incorporated by reference at the time of purchase, constitute the agreement between the Participant and Crash Acting concerning the applicable Services.
If terms expressly presented for a particular Course or Membership conflict with these general Terms, the terms specifically presented for that offering will control with respect to that offering.
XXII. ELECTRONIC ACCEPTANCE
By checking the box indicating acceptance of these Terms and completing your purchase or enrollment, you acknowledge that you have read, understand, and agree to be legally bound by these Online Course & Membership Terms & Conditions.
You further acknowledge that:
- Crash Acting's online offerings consist primarily of self-guided digital educational content;
- Unless expressly stated otherwise, Courses and Memberships contain no live instructional component;
- Access to a Community Space does not constitute a live community, coaching, or instructor-access component;
- Crash Acting instructors and staff are not required to monitor or respond to posts, questions, comments, direct messages, or other communications submitted through a Course, Membership, or Community Space;
Individually purchased Courses may be subject to one-time payment or installment payment obligations;
- A Course installment payment plan is not a cancelable monthly subscription;
- A Membership is an automatically renewing subscription and will continue to renew and be charged according to the disclosed billing frequency until canceled;
- Cancellation of a Membership prevents future renewals but does not cancel separate Course purchases or installment obligations;
- Access to Membership-only materials generally ends when the Membership ends;
- Access is for your individual use only;
- Course and Membership materials remain the intellectual property of Crash Acting and/or their respective rights holders;
- No particular artistic, professional, financial, career, or personal result is guaranteed; and
- You agree to comply with these Terms throughout your use of Crash Acting's Services.
